Expiry Date for judicial cases


Thank goodness! This case haven't come to judicial courts in India.

If two mothers come to Indian judicial courts, they may get the judgment many many years later. By that time, say 18 years, the baby would have grown up to a young woman. The mothers would have grown older; perhaps may be dead too. What will be the use of delayed judgment in that case.

In Jayalalitha's case, had they delivered this judgment in 1996, entire Tamilnadu would have celebrated the judgment. But now, it is a dead case. This case is expired.

More than political perspective, take a fresh look at our judicial system.

Indian judicial system has no expiry date for judicial cases. All other system has an expiry date.

Human life has an expiry date.
The President of United States of America - position has an expiry date of eight years.
Members of Parliament of India - position has an expiry date of five years.
The Prime Minister of India - position could expire on any date.

Everything has an expiry date. So, the judicial cases need to have an expiry date.
When a case is registered, it may carry a date; this case is valid for five years; a judgment has to be delivered before its expiry; otherwise, the case may become invalid.

So many things are not clear in our judicial system.

The Prime Minister of India has got nothing to do with this case; but, unnecessarily, his name has been dragged into this verdict.

Who has the authority to instruct the Public Prosecutor to do his job?

What is the responsibility of a Public Prosecutor?

As per the constitution, the state government appoints a person as a Public Prosecutor. There ends the responsibility of the state government.

Could the Chief Minister of Karnataka give instructions to the Public Prosecutor about handling this case?

Even this case and several other cases; we admit; judicial system cannot function without any interference, if it is in the same state; so we need to move the case to another state.

That's how this case was moved from Tamilnadu to Karnataka.

This idea itself is an insult to our judicial system.

When the government decided to send MGR to America for medical treatment, doctors in India expressed their feelings. You don't have faith in our ability; our sincerity.

But, we simply say, this case cannot function without any interference, if it is in native state.

If this trend continues, then we may transfer our judicial cases to Pakistan courts and they may transfer their cases to India.

Perhaps, Indian judicial court may take up the case of Nawaz Sharif about his election poll rigging.

Before pronouncing the quantum, the judge asked Jayalalithaa whether she had anything to say about the conviction. Speaking for the first time in the court room, Jayalalithaa called it a political witch hunt by her political opponents. She told the judge that she had suffered for 18 years because of this case and was inflicted with diabetes, hypertension and other ailments due to the same. She also told the judge that she was just 48-years-old when the case was registered against her , she was now 66, and that she had suffered enough.

In the court room, right in front of the judge, Jayalalitha said; it is a political witch hunt by her political opponents.

This statement is a direct insult to that Judge and the entire judicial system.

This statement clearly conveys the message:

Honorable Judge, you didn't write this verdict; someone else did it; you're just delivering it as a courier.

We had Manmohan Singh as the Prime Minister;
but behind the scene, Sonia was running the government.

Likewise, what we see is not what we get.

Someone else is writing the verdict and judges are delivering it as a courier.

So, naturally behind the scenes some others pulling strings.

The action is now taking place in Karnataka.

In Karnataka, Sonia is in power.

So, on this stage the actors are:

  • Jayalalitha in jail
  • Sonia in power in Karnataka
  • Modi (courtesy- Subramaniam Swamy)

As Imran Khan said; we're just donkeys; just by painting strips on our back, we cannot become zebra.

In understanding of democracy system, the Founding Fathers of America had done an excellant service to humanity.

We need to learn a lot about democracy.

Till then, let us continue with all chaos and confusion, in the name of democracy.
