Paid Time-Off for Delhi MLA


A Constitution bench led by Justice H L Dattu set the ball rolling by asking the Centre to come back to court on September 9 with a “positive” response on how to proceed about having a government in Delhi.

...the bench questioned as to how long the Assembly should be allowed to remain in suspended animation in the current political situation.

“One party says it does not have the strength.
  Other says it has no desire.
 Third party is not in a position to stake the claim.

In a situation like this, we ask why should people suffer when nobody is in a position to form government?

Citizens of Delhi want to be ruled by a government and not by the Lt Governor. Please put an end to it. Take a decision, one way or another,” the bench said.

As Additional Solicitor General P S Narasimhan said that the Centre was alive to the political situation, the bench questioned as to what endeavours they were making to support their contention. “Please tell us for how long can this state of suspended animation continue?

Elected members sit at home without any work. MLAs are drawing salaries. Why should that happen? We are not treating this as a petition by a party or any member.

We are looking at the Delhi citizen’s point of view… citizen may say they have elected representative and MLA is drawing salary without providing any service,” remarked the bench.

The Judicial Branch works in India.

The Judicial Branch of Indian Government used to look at the issues from political parties perspective; now, they start looking from citizen's perspective. In fact, we need to look at any issue from whole perspective.

We, the people of India work hard; earn; and pay tax.

Election Commission of India organizes the election.

Citizen of India stand in line and cast their vote; and elect their representative for the Legislative Branch.

Now, those MLA enjoy their paid time-off.

If we conduct another election, again it is going to cost tax money.

These tax money is white money; when citizen don't pay tax, that money is black.

White money is going waste by repeated election tamasha.
Black money getting re-invested into properties and business.
In fact, black money is the working economy.
White money is going waste in all democracy entertainments.

On seeing this fact, people try to avoid paying tax.

Ok, let us go for one more election.
It is a gambling.
We may end up with the same situation or worse than the current one.

So, let us not dissolve the Delhi Assembly.
Let us not for another election.
Let us face this current crisis and handle the current situation.

Somehow, all over the world, government means the President or the Prime Minister.
Rest of them all not even being considered as part of the whole government.

Still, the whole world functions in the same Kingdom pattern.
Long Live King.
Long Live Queen.
Long Live the President of United States of America.
Long Live the Prime Minister of India.

Still, we consider, government means, only the Executive Branch.
Even in United States, somehow, an hierarchy has been formed in the minds of the people.

They view that the President is at the top; Legislative reports to the Executive and the Judicial reports to the Legislative.

Government means a whole one. The parts are the Executive, Legislative and Judicial.

For now, the crisis in Delhi is, no Chief Minister.
That's all.

The Delhi Assembly doesn't need to be kept closed; just for this one reason.
Till they could elect a Chief Minister, let the MLA assemble and discuss about people issues.
Let the MLA discuss Delhi Power issues; water issues and other issues.
Let those MLAs suggest the Executive Governor about solving people problem.

Let them first function as MLA.
Later, out from those MLAs, a Chief Minister will emerge.

So, in Delhi, the Judicial Branch is effectively working.
Governor as an Executive is effectively working.
Let the MLA work in the Assembly.

In fact, the Legislative Assembly would function effectively, if all MLAs are equal.
In Delhi Assembly, there is no Chief Minister.
In Delhi Assembly, there are no Cabinet Ministers.
In Delhi Assembly, there is no ruling party.
In Delhi Assembly, their is no opposition.
In Delhi Assembly, all MLA are equal.

So, there will be no chaos; no confusion.
In a court, all Judges are equal.
Each Judge functions as an individual with total and complete freedom.
Let, Delhi MLA function with total freedom.
Let Delhi MLA work for the people of Delhi.
